DEKALB Swagriculture Giveaway (“Giveaway”) will run on our Twitter® social media account: @DEKALB_CA. The “Giveaway Period” is as outlined below. The Giveaway is being conducted by Bayer CropScience Inc. (“Sponsor”) and is subject to all terms and conditions of these Giveaway Rules (“Giveaway Rules”).

No purchase necessary. Giveaway is open to individuals who: a) are legal Canadian residents residing outside of the Province of Quebec who have reached the age of majority in the province in which they reside at the time of entry; and b) are farmers whose primary source of income is from commercial farming operations at time of entry (each a “Participant”). Employees, officers, or directors of the Sponsor or its affiliates or subsidiaries, its advertising and promotion agents, or those individuals residing with any of the foregoing are not eligible to enter or be Participants.
To enter, during the Giveaway Period Participants must follow the Sponsor at @DEKALB_CA and @Bayer4CropsCA and tag a twitter user profile of another farmer (an “Entry”) in comments or retweet. Limit of one (1) Entry per Participant and eligible farm operation with which a Participant farms.
- Every Entry must be Participant's original work and must not, to the Participant’s knowledge, violate any third-party copyrights or moral rights. Entry content must not include:
reference to any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;
nudity;
explicit, graphic or excessive sexual activity;
crude, vulgar or offensive language and/or symbols;
derogatory characterizations of any ethnic, racial, sexual or religious groups;
content that endorses, condones or discusses any illegal, inappropriate or risky activity, behavior or conduct;
personal information of individuals, including, without limitation, names, and addresses (physical or electronic);
commercial messages, comparisons or solicitations for products or services other than those of Sponsor; and
any other content that is, or could be considered to be, inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole discretion.
All Entries become the property of the Sponsor and will not be acknowledged or returned, and no correspondence will be entered into regarding the status of any entry. Entries that do not comply with the Giveaway Rules will result in disqualification. Incomplete or illegible entries will not be considered. This Giveaway is subject to change without notification in Sponsor’s sole discretion. Entries will be void if they do not comply with Giveaway Rules; or if they are electronically or mechanically reproduced, forged, defective, altered or obtained through unauthorized channels; or if they contain production, typographical, electronic, mechanical or other errors. Sponsor reserves the right in its sole discretion to disqualify, block and take down any Entry at any time which, in Sponsor’s opinion, is offensive, contains unsuitable material, endangers the safety or well-being of any person, does or might violate a third parties copyrights, moral rights or trademarks or does not comply with the Giveaway Rules. Any attempt by any Participant to obtain more than the stated number of Entries, including using multiple/different identities and/or accounts or any other methods, will void such Entries, and that Participant may be disqualified.
During the Giveaway Period, Sponsor will give each of the first one thousand (1000) Participants who submit eligible Entries one (1) DEKALB SwAgriculture cooler (the “Giveaway Item”). The Giveaway Item is valued at approximately $30 CAD. The Giveaway Item is not transferable, and no substitutions are allowed. Recipient is responsible for any and all costs not stated as included in the Giveaway Item. Sponsor reserves the right to substitute the Giveaway Item with an item of equivalent or greater value. Sponsor further reserves the right to give any number of additional items to Participants in its sole discretion.
Giveaway Item recipients will be contacted by phone or email or through electronic messaging. If the potential recipient cannot be contacted or does not respond within five days of the first notification attempt, is found to be ineligible, does not comply with these Giveaway Rules, or declines to accept the Giveaway Item, such potential recipient may be disqualified at Sponsor’s sole discretion. Sponsor will arrange a mutually convenient time for delivery of the Giveaway Item. Cost of delivery will be borne by the Sponsor.
Sponsor will not publicly announce any recipients of Giveaway Items.
By entering the Giveaway, the entrant agrees to be bound by these Giveaway Rules and by the decisions of Sponsor, which shall be final and binding in all respects. Participant further agrees that Sponsor and its affiliates, including their agents, representatives and those associated with them may communicate with Participant regarding his or her participation in the Giveaway via electronic message or otherwise. These Giveaway Rules are subject to change without notification at Sponsor’s sole discretion. If for any reason the Giveaway is not capable of running as planned by reason of, and not limited to, tampering, unauthorized intervention, fraud, or any other cause that Sponsor or its agents deem could corrupt or affect the administration, fairness, or proper conduct of this Giveaway, Sponsor reserves the right at its sole discretion to cancel, modify, suspend, or terminate the Giveaway and select the recipients from among the eligible Entries received prior to the action, or as otherwise deemed fair and equitable by Sponsor. The Giveaway is subject to all Federal, Provincial, and Municipal laws and regulations.
Sponsor and its affiliates, including their agents, representatives, and those associated with them, are not responsible for any Entry, Giveaway notification, or the claim for a Giveaway Item which is lost, misdirected, or which arrives late, as the case may be, whether or not due to the fault of Sponsor or of any other person or thing.
By entering, each Participant agrees to hold harmless Sponsor and its parent companies, subsidiaries, affiliates, directors, officers, employees, and agencies from any liability whatsoever, and waive and release such parties from any and all causes of action for any claims, costs, injuries, losses, or damages of any kind (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) arising out of or in connection with the Giveaway or acceptance, possession, or use/misuse of any Giveaway Item, participation in any promotion-related activity, or participation in the promotion, whether under a theory of contract, torts (including, without limitation, negligence), warranty, or any other theory or cause of action.
The Sponsor respects your right to privacy. Personal information collected from Participants will be used by Sponsor for the purpose of administering the Giveaway. Sponsor will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by Sponsor to fulfill the above purposes or as permitted or required by law. By entering the Giveaway, Participants consent to the manner of collection, use and disclosure of their personal information in accordance with Sponsor's privacy policy available at https://www.cropscience.bayer.ca/Privacy-Statement. By entering the Giveaway, Participants agree to allow Sponsor to contact them regarding the Giveaway.
